Newspaper Article (Groton Journal, NY, March 30, 1977)
AUBURN - Cayuga County Surrogate Gerald Saperstein has declared Clarence L. Brown, Jr., who disappeared while operating his boat on Owasco Lake on August 19, 1975, as legally dead.
Under usual circumstances, a person who disappears is presumed to be alive for at least five years after the disappearance. However, a section of Estates, Powers, and Trusts Law provides that "if a person is exposed to a specific peril of death, that fact may be sufficient basis for determining that death occurred on the date the person was exposed to such a hazard."Mr. Brown, formerly of Moravia, was last seen leaving his home on Owasco Lake in a motorboat which was later found empty on the Lake. Mr. Brown's body has not been recovered. The decision was handed down after hearings held the early part of last week.
