 - Newspaper Article (The Otsego Farmer, Cooperstown, NY, Friday, March 11, 1938)
Suing for a separation, Mrs. Ida Deming of Oneonta found herself defendant in a divorce suit brought by her husband, Walter Deming, of Gifford hill, due to testimony given at a threeday hearing before a referee at Oneonta. As a result, Supreme Court Justice Andrew M. McNaught, Sr., who heard the divorce testimony, last week granted an interlocutory decree to Mr. Deming.
Mrs. Deming first brought her action for separation in January, 1936, charging in her complaint, "cruel and inhuman treatment." Justice Ely W. Personius referred the case to Attorney George L. Dickson of Oneonta to hear as referee following the November, 1937, term of Supreme Court.
During the hearing before Referee Dickson, testimony revealing infidelity on the part of Mrs. Demming was brought out by Attorney James J. Byard, Jr., who represented Mr. Deming. Andrew J. McNaught, Jr., acted as trial counsel for Mrs. Deming whose attorney of record was the Hon. Frank C. Huntington.
Referee Dickson handed down an opinion denying Mrs. Demming any decree of separation and decided the case in favor of the defendant, Mr. Deming, whereupon, he became plaintiff, in immediately suing for divorce on the basis of testimony offered at the hearing.
Testimony in the divorce suit was heard by Justice McNaught at a special term of Supreme Court at Oneonta, January 21st, following which he reserved decision and handed down an opinion in favor of Mr. Deming.—-Oneonta Star.
