- Newspaper Article (The Rome Daily Sentinel, Wednesday, May 6, 1914)
Justice Irving O. Hubos has rendered a decision in favor of the plaintiff in the case of Frank Zurbrocs against Linnie Sanford, which was tried at the March term of Supreme Court in this city. The parties to the action reside in the town of Verona, and the action was brought by the plaintiff to determine whether the defendant had a right of dower in 40 acres of land situate in that town, which plaintiff had purchased about a year ago, and from which defendant had attempted to oust him and his family by various means, including, it was alleged, the use of a horsewhip.
The defendant claimed that her husband, Hall Sanford, who died in 1912, was the owner of the premises under a land contract dated June 8, 1904, and that upon his death the premises descended to his children, subject to her right of dower, instead of to the heirs of the owner at the time of the execution of the land contract, who had deeded to plaintiff.
Justice Hubbs finds that the contract claimed was made but that no part of the purchase price was ever paid by Sanford and would amount with interest to more than $1,260, while the value of the premises does not exceed $800, and further, that Sanford in his life time, assigned whatever interest he had under the contract to obtain a loan.
Judgment foreclosing the defendant of all claim of dower with cost against her in favor of the plaintiff is directed.
Ward J. Gagwin was attorney for the plaintiff and D. F. Beetle for the defendant.
