5337. Irvin A Weaver

 - GFG - I
 - 1880 census, Oppenheim, Fulton, NY, fam # 268 - He and his family were living with his parents.
Newspaper Article (Fulton County Republican, Johnstown, NY, July 28 (?) 1887)
The Man With The Coat of Tar - The following particulars of the disgraceful proceedings, enacted in Oppenheim, as noticed in these columns last week, were furnished to the Sunday World by St. Johnsville parties:
About three miles northeast of Oppenheim, in Fulton county, is a settlement known as "The Swamp." The residents are generally of loose morals and the reputation of the locality is anything but what it should be. Ervin Weaver, once a respected citizen, and who is well connected, for years resided with his wife at this place. About a year ago, Weaver's wife's sister, Ettie Sparks, came to visit them. The report gained currency that Weaver was shamefully abusing his wife and was inclined toward his wife's sister. The air was filled with rumers of cruelties to his better half, and it soon became so warm for Weaver that he and the girl fled for the far West. The wife tried to gain an honest livihood and was getting along nicely, when about six weeks ago Weaver returned. Woman like, she recieved her husband on his promise to lead a better and a different life, and all things went well for a few weeks, when the wife's sister reappeared in the shades of the slimy swamp.
Stories of Weaver's faithlessness to his wife and his almost inhuman treatment of her agian reached the public ear. Indignation grew until, a few nights ago, the men of the or some other community, determined to teach Weaver a lesson that he would remember. Accordingly eleven men organized themselves into a possie. They disguised their faces with shoe blacking and turned their outer garments inside out, and with heavy natural wood canes marched to the Weaver domicile. The latch-string was not out, but a window pane was, and in short order a member of the gang was in the house, and had opened the door for the remainder. Weaver and his wife were in the lower room and the girl was upstairs. Mrs. Weaver was the first to awaken, and she set up a yell. Two of the men seized her, and one said kindly: "We do not intend to hurt you, but you must keep still. It will be better for your health." Only one of the masked men spoke and his voice was described by Weaver as very hoarse. Weaver endeavered to work upon their sympathies, but to no purpose. He was told "It would be better for his health if he obeyed without mufmurring." He begged to be allowed to dress be was told it would be wasting time.
Five of the men then took Weaver in a nude condition, two having him by the arms and three keeping guard at a distance, over the fields toward thehouse of a neighbor named Hart, about one-half mile distance. Hart's dog set up a barking which aroused the family. Hart with only his trousers on, ran out to the gate as the procession was approaching, and seeing something was wrong said, "What are you villans doing with that man?" Mr. Hart received a whack over the head which he did not expect, and was told if he interfered further it "would not be healthy for him". He ran into the house and stayed there. Near Hart's barn was a wagon. On this wagon Weaver was laid and strapped down. He was so tied that it was with great difficulty that he could breathe. It is actually believed that he would have died before mornig if he had not been assisted at daybreak by Hart, who was watching the operation from a dormer window. The Posse, when Weaver lay motionless covered his person with smeary tar and then upset a bag full of feathers over the tar. He set up a fearful hell at first, but the tightening of the strap about his neck was effective. In this position Weaver was left to watch the sun tise. Then the five menwent back to the Weaver house, where the other six stood guard over the women. The wife was then told ro retire and cautined that if she recognized any of the masked men and "gave them away" it would not be "healthy" for her. The girl. the source of all the trouble was removed by the eleven men to the house of another neighbor, where she was told to go in and stay till morning.  First however, she was told she deserved tar and feathers, this time they would let her off, but if she ever came to that locality again, under any circumstances it would be "unhealth" for her. She left the neighborhood and has not there been seen.
Hart at day light assisted Weaver to clean up. He is nearly free form all traces of teh night's outrage, but is the maddest man in all this section. He is looking for some one to arrest, but as yet no one has been positively identifed. The neighbors think that the gang of men were from Lasselsville, others from St. Johnsville. Anyway Weaver said the spokesman was a stranger to him. The affair is the topic of conversation in the county around about. Weaver and his wife are now living together. It has been reported that the disguised men acted very --- toward the woman, but Mrs. Weaver said they used her like a lady.
 - Newspaper article (Johnstown, September 4, 1887)
ARRIVED TOO LATE. -The quiet little hamlet of Oppenheim has been in a furore for Several weeks past, it will be remembered that in July a man named Irving Weaver was treated to a coat of tar and feathers in order to reform his morals which had become of a dilapidated nature. This resulted in the arrest of one DeWitt Mosher, as the principal in the reform movement. Mosher was tried and bound over to the grand jury. Furnishing ample bond, he was allowed to run at large. Last week he induced Kittie, the 16 year, old daughter of George Hart, to elope with him. Her father, hearing of the affair started immediately in hot pursuit, and reached the justice office just as he had pronounced the couple man and wife.

Emma M Mosher

 - Newspaper Article (The Evening Times, Little Falls, NY, April 2, 1888)
At the Fultlon County, Court of Session, Dayton Mosher; of Oppenheim, was found guilty of committing a criminal  assault on Mrs. Emma Weaver and was sentenced to twelve years imprisonment in Danemora State Prison.. It will be remembered by our readers that some months ago some of the residents of Oppenheim decided to take the law in their own hands and tar and feather Ervin Weaver, who they claimed was keeping a house for immoral purposes. Mrs. Emma Weaver, wife of Ervin Weaver at the trial testitied that four men with lamp, black on their faces came to their house after they had retired and took Ervin Weaver from the house saying they were going to tar and feather him; that while these men had her husband out Dayton Mosher entered her room and criminally assaulted her, threatering to kill her if she offered any resistance. Tne defence endeavored to prove that Mosher was not near the house on the nigtit in question, that the woman is not of good character, and that jealousy prompted the Weavers to prosecute him.
